(1.) PETITIONER - Balwinder Singh Aulakh has approached this Court under Section 482 of the Code of Criminal Procedure for a direction to the respondents to register the F.I.R. on the basis of Annexures P -1 and P -3.
(2.) ANNEXURE P -1 dated 4.7.1990 addressed to the Senior Superintendent of Police, Batala, was sent by Sukhdev Singh, claiming himself to be a close relation of petitioner - Balwinder Singh. He has alleged therein as follows :
(3.) THE complainant along with Balbir Singh and Harbans Singh was present in the head office of Asiad General Finance Company Ltd. (of which the petitioner Balwinder Singh is the Managing Director) on 3.7.1990 when fifteen persons came in tractor trolleys in the noon hours with weapons. Some of them were having fire arms also. Out of these persons two persons identified by the complainant are Doctor Dhaliwal resident of Batala and Harjinder Singh Arora, who was Manager in the Hotel Asiad. All these fifteen persons had formed themselves into an unlawful assembly with the intention to cause the death of Balwinder Singh. These persons terrorised the employees of the company the complainant and other persons present there. They took away the furniture, the office record, Godrej Almirah, fans and thereafter they looted the Asiad Hotel and took away colour Television, VCR, two air conditioners, standing fans, six ceiling fans, double bed, fridge, sterio, crockery and wall clocks.
