(1.) THIS petition is by father -in -law, mother -in -law and sister -in -law of the complainant, Rupinder Kaur under Section 482 Cr.P.C. for quashing of FIR. No. 20 dated 14.1.1994, P.S. Kharar, under Sections 498 - A/406/34 I.P.C. filed in the Court of J.M.I.C. Kharar against the petitioners and their co -accused Jatinder Pal Singh in the said case, and all the subsequent proceedings therein.
(2.) IT is necessary to note the following facts. Rupinder Kaur (complainant), who is citizen of Australia was married to Jatinder Pal Singh on 30.12.1990 according to Hindu rites. After marriage she remained in her in -laws house for 12 days. It is alleged that after a few days, the petitioners started harassing her saying that she has brought less dowry. Her ornaments were taken into possession by father -in -law and mother -in -law and when she demanded back, she was put off on the pretext that Gurpreet Kaur had given the ornaments to some and the complainant should get new ornaments made in Australia. It is the further case of the complainant that her grand -father handed over the money to Didar Singh (father -in -law) for the purchase of air ticket to Australia for Jatinder Pal Singh (husband of the complainant), who went to Australia in 1991. In February, 1993 she gave birth to a son and after that Jatinder Pal Singh left her and went to Malbourne saying that in case she could not arrange for her parents -in -law to come to Australia, then she should get divorce from him. On 26.12.1993, Didar Singh went to her grand -father at Pinjore and asked for Rs. 1 lakh for going to Australia. On 2.1.1994, her grand -father and Sardar Prithipal Singh Grewal came to her in -law's house at Kharar where the petitioners demanded Rs. 1 lakh and said that they shall not keep the complainant if this money was not given. The matter was reported to the police where the petitioners were called but nothing could be done. After registration of the case, the matter was investigated and police submitted report under Section 173 Cr.P.C. for the offences as stated above.
