JUDGEMENT

(1.) This shall dispose of Civil Writ Petitions No. 10606 and 11094 of 1997.

(2.) In both these writ petitions, challenge is to No Confidence Motion dated 4.8.1997 which was carried out against Balraj Sharma, President of the Municipal Committee and proposal dated 24.9.1997 whereby Bhagwan Dass was elected as President of the Municipal Committee, Narwana.

(3.) In brief, the facts are that legislature of the State of Haryana introduced Haryana Act No. 3 of 1994 published in the Haryana Government Gazette amending Haryana Municipal Act, 1973 (in short the 1973 Act). Section 9 of the Principal Act was substituted with the following section :
