(1.) This judgment disposes of eight R.F. As. Nos. 162 to 165, 287, 328, 69 and 488 of 1987 preferred by the landowner claimants whose lands stands acquired in pursuance of a notification published under section 4 of the Land Acquisition Act (for short, the Act) on 15th January, 1982, for the construction of a Tourist Complex by the Haryana Tourism Department. This complex has now concededly come to be known as 'King Fisher Tourist Complex' on the Sher Shah Suri Marg leading from Amritsar-Ambala to Delhi. Though initially the Collector evaluated this land purely on the basis of its agricultural kind and quality yet as a result of the respective references sought by the landowner appellants the District Court, Ambala, has determined its market value in the following manner :
(2.) So far as the location and on that account the potentiality of the land in question is concerned there is absolutely no dispute. This is what has been found by the Court in this regard :
(3.) So far as the first question is concerned I am of the opinion that there was hardly any justification with the lower Court to categorise the land into blocks for purposes of valuation. It is patently established on record in the light of the site plan Exhibit PW. 3/8 that the land is sandwitched between the G.T. Road, i.e., Sher Shah Suri Marg and Vita residential colony. In other words, the farthest end of the acquired land may be away from the G.T. Road but is closer to the residential colony. Otherwise also it is well laid down the when land is to be evaluated on the basis or its potential, then normally speaking, no belts have to be resorted to. I, therefore, discard the belts as carved out by the lower Court.
