TARA CHAND Vs. PARKASH CHAND AND ANOTHER

JUDGEMENT

(1.) Parkash Chand, landlord filed a petition under Section 13 of the East Punjab Urban Rent Restriction Act, 1949. On the pleadings of the parties, following issues were framed :-

(2.) The learned Rent Controller decided issue No. 1 in favour of the tenant and consequently dismissed the ejectment application. Learned Appellate Authority reversed the finding of the learned Rent Controller on issue No. 1 and thus allowed ejectment petition.

(3.) Dispute between the parties centers round issue No. 1 only and the findings of the Authorities below on issues No. 2, 3 and 4 have not been assailed before me and the same are, therefore, hereby affirmed.
