JUDGEMENT

(1.) This is appeal by Brahm Dutt. It is directed against the judgment of Shri Sewa Singh, Sessions Judge, Amritsar dated January 24, 1967. By that judgment, the appellant has been convicted under Section 323, Indian Penal Code and sentenced to rigorous imprisonment for one year and to pay fine of Rs. 500.00 or in default of payment of fine to further suffer rigorous imprisonment for six months.

(2.) The appellant has three other brothers. He along with his brothers and father was residing in Sharifpura in the city of Amritsar. The appellant was working as Pansal Nawis in the Canal Office at Ranewal Bridge in Amritsar.

(3.) Couple of months prior to the date of occurrence, which came off on September 1, 1966, the appellant married second time. The appellant was anxious to separate from the rest of the family. The other members of the family did not like that idea of the appellant and dissuaded him from living separate from them. His mother was sore about it.
