The petitioner has approached this Court for grant of concession of regular bail in case FIR No. 02, dated 03.01.2017, under Sections 302, 307, 148 and 149 IPC and section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, registered at Police Station Bajakhana, District Faridkot.

As per the FIR, the role attributed to petitioner, Gurpreet Singh @ Soni is that he was armed with a wooden handle and he raised a lalkara that in case anybody came forward, he will not be spared. This lalkara was given by petitioner, Gurpreet Singh @ Soni after the husband of the complainant, Jaswinder Singh, had been attacked by one Ashwani Sharma and Baljit Singh @ Balli son of Jaskaran Singh. The nephew of deceased Jaswinder Singh, husband of the complainant, when came forward on hearing the noise to rescue him, then Ashwani Sharma and Baljit Singh @ Balli attacked him as well on his chest and other parts of the body. No overt act has been attributed to the petitioner except that he had given a lalkara and was armed with a wooden handle. No injury has been attributed to him to any of the two persons. The petitioner was arrested on 04.01.2017 and is in custody since then.

Counsel for the State as also counsel for the complainant have vehemently argued that the petitioner is a henchman of the Baljit Singh, liquor Thekedar, who along-with other co-accused gave merciless blows upon deceased Jaswinder Singh and injured Devinder Singh. They contend that the petitioner may not be granted the concession of regular bail.
