JUDGEMENT

(1.) Application is allowed and the delay is condoned.

(2.) Defendant-appellant is in the regular second appeal against the judgment passed by the learned First Appellate Court partially reversing the judgment and decree passed by the learned trial Court refusing specific performance of the agreement to sell but ordering refund of the amount paid along with appropriate interest.

(3.) In the considered opinion of this Court, following substantial question of law arise for consideration:-
