PUNJAB STATE COOPERATIVE SUPPLY AND MARKETING FEDERATION LTD Vs. PRESIDING OFFICER, LABOUR COURT AND ANOTHER

JUDGEMENT

(1.) It is stated in the application that against the impugned order passed by the learned Single Judge, the Management had filed Special Leave Petition directly in the Hon'ble Supreme Court. However, the Supreme Court observed that against the order of the learned Single Judge of the High Court, Intra Court appeal is maintainable and thus while granting liberty to the petitioner to file an appeal before the Division Bench of the High Court within 30 days from the date of order, the Special Leave Petition was disposed of. It was also noticed in the order that the counsel appearing before that Court, on instructions from the respondent, stated that the respondent shall not raise the question of limitation.

(2.) Aggrieved by the impugned order passed by the learned Single Judge on 20.9.2006, present Letters Patent Appeal has been filed by the appellant- Punjab State Cooperative Supply and Marketing Federation Limited.

(3.) The appellant had challenged the award dated 2.3.1989 made by the Labour Court, Bathinda whereby reference was answered in favour of the respondent- workman.
