JUDGEMENT

(1.) The petitioner-Union of India has invoked the extra ordinary writ jurisdiction of this Court against the order passed by the learned Tribunal granting interest @ 6% on the delayed payment of death-cum- retirement gratuity and commuted value of pension.

(2.) The applicant before the Tribunal was relieved from his duties on 12.04.2004 after taking voluntary retirement but the death-cum-retirement gratuity amounting to Rs. 2,10,920/- and commuted value of pension amounting to Rs. 3,86,140/- was not paid. Since there was delay in making the payment, the Tribunal directed the petitioner to pay interest @ 6%.

(3.) Learned counsel for the petitioner contends that since the applicant was paid full amount of pension, therefore, interest on the commuted value of pension is not tenable.
