RAMESH Vs. STATE OF HARYANA AND OTHERS

JUDGEMENT

(1.) The petitioner, who has been working as Beldar with respondent No. 3, has approached this Court for quashing order dated 31.12.2007(P-9) passed by the Vice-Chancellor of Maharishi Dayanand University, Rohtak-respondent No. 3 rejecting his claim that he is entitled to be transferred to the University after the administrative control of the University College, Rohtak was taken over by the State of Haryana in pursuance to order dated 25.4.2006 and subsequent orders dated 14.12.2006, 30.5.2007 and 31.5.2007.

(2.) Brief facts of the case are that the petitioner was appointed on the post of Beldar for a period of three months on temporary basis in the University College, Rohtak on 15.11.1980 (P-1). The afore-mentioned service of the petitioner was extended from time to time and he continued working on the post. On 14.3.1995 (P-2), the services of the petitioner were regularised and an express order consequential to the resolution passed by the Executive Council dated 26.6.1993 was issued. In order to appreciate the whole controversy, it would be necessary to read the order dated 14.3.1995, which reads as under :-

(3.) The right to post you either at Rohtak or P.G. Regional Centre, Rewari or at any other place within the jurisdiction of the University shall vest with the University and you will be required to stay within the jurisdiction of municipal area of your place of posting.
