(1.) THIS is a petition filed by Jagir Singh complainant and also the father of the deceased. It is directed against the judgment passed by the learned Additional Sessions Judge, Gurdaspur dated 4.10.1995. The learned trial court had acquitted the respondents for the offence punishable under Section 304 -B of the Indian Penal Code.
(2.) THE relevant facts alleged by the prosecution are that Harinder Kaur deceased was married to respondent Kuldip Singh in March, 1987. Immediately after the marriage the respondents started torturing her for bringing more dowry. The demand was for a scooter, television and certain other articles. In February, 1992 the deceased had come to her parents' house at Amritsar to attend the marriage of her brother. In presence of her maternal uncle, she told the petitioner that she was being tortured for bringing more dowry. Thereafter she went back to the house of her husband. On 27.10.1992 the petitioner received a telephonic message that Harinder Kaur has died in Civil Hospital, Gurdaspur. He went to the Civil Hospital, Gurdaspur and saw the dead body. The cause of death was stated to be poisoning. Petitioner made a report to the police and after investigation, challan was submitted under Section 173 Cr.P.C. against the respondents.
(3.) THE learned trial court on appraisal of the evidence held that prosecution has failed to prove its case beyond all reasonable doubt. Accordingly, the respondents were acquitted.
