JUDGEMENT

(1.) Subordinate Services Selection Board, Haryana (for short the Board) advertised 31 posts of Lecturers in Sanskrit. The qualification prescribed for the post was M.A. in Sanskrit. Petitioner who has passed the Examination of Acharya from Kurukshetra University, applied for the post on the basis that the Degree of Acharya was equivalent to M.A. in Sanskrit. He was interviewed by the Board and his name appeared at Sr. No.II in the list of successful candidates. It is common case of the parties that candidates lower in merit than the petitioner have been appointed whereas the petitioner has been ignored for appointment only on the ground that he was not eligible for the post. The case of the respondents is that the degree of Acharya possessed by the petitioner is not equivalent to M.A. and, therefore, he did not possess the requisite qualification prescribed for the post.

(2.) The sole question that arises for determination in this case is whether the degree of Acharya obtained by the petitioner can be treated as equivalent to M.A.

(3.) The Haryana Government has issued instructions to the effect that all Degrees and Diplomas which are recognised by the Government of India would be deemed to have been recognised by the State of Haryana as well. The Government of India as per its letter dated Jan. 23, 1964 addressed to all Education Secretaries of the State Government /Union Territory Governments and Registrars of all Universities impressed upon them that they should employ at least one traditional Sanskrit y Scholar who should enjoy the same status and pay scale as his counter-parts on modern lines with equivalent degrees.
