(1.) When the case was taken up for hearing the husband filed an applicantion under Order 6 Rule 17 of the Civil Procedure Code, for amendment of the divorce petition under Section 13 to Section 13-B of the Hindu Marriage Act, 1955 , and along with it filed joint petition duly signed by the parties for divorce by mutual consent.
(2.) Amarjit Kaur respondent is present in person. Darshan Singh and Piara Singh, brothers of Amarjit Kaur are also present. Amarjit Kaur and her brothers were asked about the genuineness of the joint petition seeking divorce by mutual consent. She admitted her signatures at the two places on the petition and her brothers also stated that it is in her interest to obtain divorce by mutual consent so that she can be married somewhere else as it is imopossible for the parties to live together.
(3.) Accordingly, the application for amendment is allowed and the application for divorce by mutual consent is hereby granted. The appeal stands disposed of leaving the parties to bear their own costs.
