(1.) THE incident is said to have taken place on 25.3.1987 and Shri Pritpal Singh, Inspector got information of this incident only on 4.4.1987. The name of the person who gave this information is not mentioned and is not expected to be mentioned under law. But the question is whether this information is correct or not and to give a finding on the secret information will not be a judicial exercise at this stage. Even otherwise, the addresses were given by the persons mentioned in the first information report, but the name of any person in the gathering listening to the addresses is not given. This is quite similar to the case of Balbir Singh v. State of Haryana, 1987(1) R.C.R.(Criminal) 401 : AIR 1987 Supreme Court 1053, where it was held by their Lordships of the Supreme Court that such type of investigation does not convince the judicial mind. In view of these circumstances, I without going into the merits of the case, order the release of the petitioner on bail to the satisfaction of Chief Judicial Magistrate, Faridkot.
