(1.) THIS reading of the first information report reproduced in the petition shows that Mange Ram, the father of the deceased, went to meet his daughter at about 9 A.M. on 28 -4 -1987 at the house of Hira Lal in village Lisan and heard a voice saying fire has broken out" from inside and on hearing this many ladies rushed inside and be also went inside and saw that his daughter Santosh had caught fire. The only eye -witness account of Mange Ram is that be saw his son -in -law Rajinder jumping over the wall and running away without making comments about the probability of Mange Ram's presence at the very opportune time and the only evidence of conduct of the petitioner in running away after he had seen his father -in -law, the fact that Mange Ram kept quiet after seeing all this and lodged the report only on 6 -5 -1987 cannot be ignored. In view of all these circumstances, it is prima facie a case for release of the petitioner on bail. He is, therefore, directed to be released or bail on his furnishing adequate security to the satisfaction of the Chief Judicial Magistrate, Narnaul. However, anything observed herein will be irrelevant for purpose of trial.
