JUDGEMENT

(1.) Criminal Appeal Nos. 164-SB of 1985 and 174-SB of 1985 are being disposed of by this judgment as they arise out of a common judgment, after a joint trial of the appellants by the trial Court, ending in their conviction and sentence.

(2.) The appellants have been tried on charges under section 120-B of the Indian Penal Code (Briefly the Code), read with section 5(2) and section (1)(d) of the Prevention of Corruption Act (briefly the Act) and sections 467 and 471 of the Code, for Kashmiri Lal extending undue pecuniary advantage to the extent of Rs. 3,7361 and 10 paise in respect of telephone bills of the phone No. 2379, installed at the residence of Jagjit Singh appellant and telephone No. 2644, installed at the business premises of firm Mis Gurcharan Singh Jagjit Singh, New Sabzi Mandi. Patiala, after false entries were made in pursuance of the criminal conspiracy in the excess payment register, adjustment register and KM sheets in respect of these telephone numbers.

The trial Court examined Madan Singh (P.W. 1); Bhagat Singh, Postal Assistant (P.W. 2); Parshotam Dass, Clerk Postal Assistant (P.W. 3); Swaran Singh, Telephone Clerk (P.W. 4); Fateh Chand, Junior Accounts Officer (P.W. 5); Karam Chand, Assistant, Telecom Office (P.W. 6); Shri S.S. Nijjar, Divisional Engineer Phones (P.W. 7); A.N. Parbhakar, Accounts Officer (P.W. 8); Surjit Singh, Head Clerk (P.W. 9); Joginder Singh Shah (P.W. 10); S.K. Saxena, Examiner of Questioned Documents (P.W. 11) and Inspector Gurdial Singh. C.B.I., SPE, Chandigarh (P.W. 12) and thereafter the Public Prosecutor dosed the prosecution evidence.
