JUDGEMENT

(1.) PETITIONER No. 1 is the father of petitioners No. 2 and 3. Present case was registered on a secret information with regard to the allegations mentioned in the F.I.R. under Sections 3 and 4 of the Terrorist and Disruptive Activities (Prevention) Act, 1985. In pursuance of the information, the police party is said to have gone to the place disclosed in the alleged secret information but found nothing there. On the same day these three petitioners were arrested at a different place situate in Police Station Sadar Taran Tarn and three separate cases were registered under Section 25 of the Indian Arms Act. It is stated that in those three cases all the three petitioners have been released on bail which fact is not denied by the opposite side. The petitioners are in custody since Ist August, 1986 and till now no challan has been produced. The fact remains that the case was registered against the petitioners on a secret information which remains uncorroborated. In the circumstances, I am satisfied that there are reasonable grounds to believe that they were not guilty under sections 3 and 4 of the said Act and as they had already been released on bail in separate cases by the Court concerned, the petitioners are not likely to commit any such offence. The petitioners are ordered to be released on bail to the satisfaction of the C.J.M. Amristar who will see that they should give an undertaking that they would not commit any such offence. Bail allowed.
