(1.) Malwant Singh Dosnjh and Rana Baljit Singh Grewal with Roll Nos. 91852 and 91857 respectively appeared for Higher Secondary Part II Examination held by the Punjab School Education Board, (hereinafter referred to as the Board) that is, the respondent, in March, 1975. The Centre of examination was G.H.R. Khalsa Higher Secondary School, Dosanjh Kalan. The result of both the petitioners was detained and the Board made out a case against them for copying and adopting unfair means in English paper 'A'. The petitioners were summoned by the Board and were given questionnaries, which the petitioners answered. After giving them the opportunity, the Board formed the opinion :-
(2.) The Board in its written statement defended its action and stated that Malwant Singh Dosanjh is the son of Principal of G.H.R. Khalsa Higher Secondary School, Dosanjh Kalan, and Rana Baljit Singh Grewal is the son of the Secretary of the management of that School. The Deputy Superintendent of that examination centre was staying in the house of Rana Baljit Singh Grewal and for that reason the Superintendent of the Centre was known to him, and that because of the interest of the Superintendent the help was rendered to the petitioners by way of unfair means. It was averred that answers to Question No. IV(a) and IV(c) of both the petitioners were the same word for word and it was so found by the Head Examiner.
(3.) Before me Shri G.S. Tulsi, learned counsel for the Board, has stated that the order of disqualification concerns only to the answers of Question No. IV(a) and IV(b). The case of the Board is that the answers to this question in the answer books of both the petitioners tallied with each other. The gravement of the charge is to be found in Question No. 3 of the supplementary questionnaire of Malwant Singh Dosanjh, where the question is recorded as :-
