(1.) Baljit Singh, the petitioner has sought regular bail in FIR No. 20 dated 15.03.2017 , Police Station Sadar Gurdaspur, for an offences punishable under sections 420, 465, 467, 468, 471, 120-B IPC.

In the FIR, which has been registered on the statement of one Sukhwinder Singh, it has been who alleged that his son namely Harmanjit Singh had passed his XII Class and had appeared in BCA examination. One Pardeep Kumar, who was known to him gave an offer that he would get his son appointed in some Central Government Department for a consideration of Rs.5,50,000/-. He introduced one Palwinder Singh Chahal, who himself claimed to be a Director of National Handicap Finance Mehla Development Corporation. During various meetings, a total sum of Rs.5,50,000/- was given to said Palwinder Singh Chahal. Even a letter purpoted to be an offer for the permanent post of Clerk in the National Handicap Finance & Mehla Development Corporation Ministry of Social Justice, Government of India was handed over to the son of the complainant. Palwinder Singh Chahal however did not permit the son of the complainant to join on the post of Clerk with the assurance that he would get him appointed on a higher post. On that promise the son of the complainant had given the test for the post of Secretary at Merut Division Saharanpur on 4.12.2014. He was also given a letter purported to be a joining letter for the post of Secretary, Merut Division, Saharanpur. However, the letter turned out to be a fake letter. When the complainant asked for joining of his son on the said post, the petitioner and Palwinder Singh Chahal put off the matter on one pretext or the other. 4. Learned counsel for the petitioner states that the allegation of promise for providing the job to the son of the complainant and allurement are against Palwinder Singh Chahal and Pardeep Kumar. The only role attributed to the petitioner is that he handed over a joining letter to the son of the complainant at the behest of Palwinder Singh Chahal. The petitioner was an employee with said Palwinder Singh Chahal and whatever letter was handed over to him, he passed the same where ever directed without knowing the contents thereof. 5. Learned counsel for the petitioner further states that the matter has been compromised between the complainant and Pardeep Kumar and Sukhwinder Singh. The complainant has also given an affidavit to this effect that he has no objection if the proceedings in the FIR are quashed. The petitioner is in custody since 26.04.2017 and the challan has been presented before the Court. 6. Considering the aforesaid facts, without commenting on the merits of the case, the present petition is allowed. The petitioner be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate Gurdaspur.
