(1.) All the afore-mentioned petitions have been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioners in case FIR No.83 dated 16.06.2016 registered for the offences punishable under Sections 18 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 and 489-C read with Section 120-B and 201 of Indian Penal Code, at Police Station Maloya, Chandigarh.
(2.) This is a case having peculiar facts. As per case of prosecution, one Bhagwan Singh was apprehended by the police party of Police Station Maloya on 16.06.2016 on the basis of secret information and 2 kg 600 gms of opium along with fake currency was recovered from his possession. After the registration of the case, the police conducted investigation and found that said Bhagwan Singh had been got implicated under a conspiracy by a number of persons including petitioners Navjot Singh Dhaliwal, Narinder Singh, Tarsem Singh, Advocate Jatin Salwan and several other persons.

During investigation, accused Bhagwan Singh disclosed that he was sent by his owner Sukhbir Singh Shergill (who is running and institute at Mohali) to collect some files from a person named Mr. Bhinder. Under the direction of Sukhbir Singh Shergill, he had talked to one Mr. Bansal at telephone No.+12044000940, who asked him to collect the file from Mr. Bhinder at Dhillon Barrier. He apprised Mr. Shergill about his conversation with Mr. Bansal and then went to Dhillon Barrier but no one was found there. He again informed Mr. Shergill about it and then received a call from Mr. Bansal, who directed him to collect the files from near Shakti Bhawan, Panchkula. On reaching near Shakti Bhawan, Panchkula, a lady came there and placed a bundle of files in his car. On inquiry by Bhagwan Singh about her identity, she made him to talk to Mr. Bhinder, who asked him to come to Sector-40, Chandigarh to meet him. On his way to Sector-40, Chandigarh, he was apprehended by the police.
