(1.) By filing the present petition under Section 439 of the Code of Criminal Procedure, the petitioner has sought regular bail in FIR No.176 dated 22.07.2014, registered under Section 302 read with Section 34 IPC, at Police Station Samrala, Distt. Ludhiana.
(2.) Contends that there is nothing against the petitioner except the confession of the petitioner made before PW3-Manjit Singh. Said Manjit Singh has been stated to be a stock witness. State has filed a short affidavit wherein said Manjit Singh has been shown to be witness in four other FIRs. The petitioner is in custody since 23.07.2014.
(3.) On the other hand, the learned State counsel and learned counsel for the complainant vehemently oppose the present bail petition. The learned counsel for the complainant states that the complainant is being threatened by the petitioner. However, he is unable to place on record any material in support of his assertion.
