(1.) As per the prosecution allegations, Gurcharan Singh was, besides being belaboured otherwise, done to death with the indicated Mahindra tractor bearing no. PB-04-F8640 being run over him. As per the prosecution allegations, the tractor was driven by the petitioner Kulbir Singh. There was a dispute between the parties on account of demarcation of shamlat land. Gurcharan Singh was, at the relevant point of time, accompanied by his grand son / first informant Gurmeet Singh son of Kartar Singh who, too, was belaboured by non-petitioner Kuldeep Singh with a dang.
(2.) The prosecution allegations against the petitioner-accused are very serious. The trial is already in progress and I do not find any adequate ground to order the release of the petitioner on bail during trial. The bail plea shall stand declined accordingly.

Learned counsel for the petitioner points out that at this stage that in a bail plea preferred by a non-petitioner co-accused Interjit Singh, this Court had directed that if the trial is not concluded within a period of six months with effect from the indicated date, then the petitioner shall be released on bail by the Trial Court to its satisfaction (copy Annexure P/2). A noticed in Annexure P/2 itself, that order was passed on the basis of a similar order passed on a bail plea filed by Kirpal Singh.
