JUDGEMENT

(1.) THE prayer in this application is to suspend the sentence awarded to the applicant-appellant No.2 (Smt.Balwinder Kaur wife of Visakha Singh). THE applicant-appellant No.2 has been convicted under Section 306 IPC and sentenced to undergo 5 years' rigorous imprisonment. Undisputedly, she has already undergone actual sentence of 1 year and 8 months.

(2.) THE applicant-appellant No.2 is an old woman of 60 years of age.I have heard learned counsel for the parties on merits also. THE appeal is of the year 2006 and is not likely to be taken up for final disposal in the near future. Having regard to all the attending circumstances, the sentence awarded to applicant-appellant No.2 (Smt. Balwinder Kaur wife of Visakha Singh) is ordered to be suspended and she is directed to be released on bail to the satisfaction of the Chief Judicial Magistrate, Hoshiarpur.
