JUDGEMENT

(1.) THIS appeal is directed against the award dated 6.2.2006 passed by the Motor Accident Claims Tribunal, Panchkula. The Tribunal has awarded a sum of Rs. 5,45,000/- to the claimants on account of death of Kulwant Singh, husband of appellant No. 1 and father of appellant No. 2 and son of appellant Nos. 3 and 4. The Tribunal has determined the age of deceased as 34 years. The deceased was working as Assistant in Family Planning Association of India and was getting salary @ 4500/- per month. The appellants tried to establish before the Tribunal that the deceased had an additional income of Rs. 5,000/- per month from dairy business. The only evidence produced was DW-3 Jasmer Singh who stated that he was purchasing milk @ 15/- per litre from the deceased. The Tribunal has categorically held that there is no convincing evidence as regard the dairy business is concerned and to my mind rightly. For running dairy business one needs necessary permission/licence and no evidence has been led to prove that. The multiplier applied by the Tribunal is also correct. I find no reason to interfere in the award. This appeal is accordingly dismissed. Appeal dismissed.
