Petitioner Randhir Singh, apprehending his arrest in a nonbailable offence in case FIR No. 17 dated 7.1.2007 under Sections 420, 406, 506/34 IPC, registered at Police Station City Karnal, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.
(2.) On January 25, 2007, interim anticipatory bail was granted to the petitioner subject to his joining investigation. I have heard counsel for the parties and have gone through the contents of the FIR as well as the order dated 17.1.2007, passed by Sessions Judge, Karnal, whereby bail application of the petitioner has been dismissed.

Counsel for the petitioner contends that the aforesaid FIR was registered on the allegation that the complainant paid Rs. 20,000/- to Sorabh Bali, co-accused of the petitioner, in order to make the said amount double. It is alleged that Sorabh Bali promised the complainant to return Rs. 40,000/- after ten days. Counsel further contends that the petitioner has not been even named in the FIR and the police wants to falsely implicate him in the case.
