AMAR NATH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Reply on behalf of respondent-4 filed in Court today. The same is taken on record.

(2.) The detenus Kanta Devi wife of Amar Nath petitioner and Mamta Devi d/o Amar Nath petitioner are present in Court. They have been identified by Ms GK Hundal, Advocate for respondent-4. It is stated by both of them that they are living with their brother and maternal uncle Sohan Lal respondent-4 respectively of their own free will. The report of the Warrant Officer dated 7.2.2007 also states that the detenus had stated that they were living of their own and they were willing to join the company of the petitioner subject to surety given by the petitioner that he will keep them in harmony.

(3.) Keeping in view the fact that the detenu Kanta Devi is living with her brother and detenu Mamta Devi is living with her maternal uncle Sohan Lal of their own free will, no writ in the nature of habeas corpus is required to be issued. Consequently, the criminal writ petition is dismissed.
