GURCHARAN SINGH ALIAS CHARNA Vs. STATE OF PUNJAB

JUDGEMENT

(1.) PETITIONER Gurcharan Singh @ Charna has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.5 dated 5.2.2007 registered under Sections 22/61/85 of the NDPS Act at Police Station Joga, District Mansa.

(2.) I have heard the counsel for the petitioner and gone through the contents of the FIR. From the possession of the petitioner, who is not holding any licence, 85 plastic bottles of Recodex syrup measuring 100 ml. each, 220 packets of Momlit tablets, containing 100 tablets each, total 22,000, 240 packets of Prenotil tablets containing 100 tablets each, total 24,000 and 2500 tablets of Diazepam 5 mg. each packet containing 50-50 tablets, were recovered on he spot. After hearing the counsel for the petitioner and keeping in view the alleged recovery and the provisions of Section 37 of the NDPS Act, I am not inclined to grant regular bail to the petitioner.
