JUDGEMENT

(1.) THIS is an application for bail filed under Section 439 of the Code of Criminal Procedure in case bearing First Information Report No. 361 dated 25th June, 2006 under Sections 307 read with Section 34 of the Indian Penal Code and 25 of the Arms Act, registered at Police Station, Udyog Vihar, Gugaon.

LEARNED counsel for the petitioner has contended that Purshotam and Jitender, co-accused of the petitioner, have been admitted to bail by the trial Court by orders dated 3rd November, 2006 and 13th December, 2006 respectively. The petitioner is in custody since 29th June, 2006. Without expressing any opinion on the merits on the case, taking into consideration the facts narrated above, this Court is of opinion that it is a fit case to grant bail to the accused-petitioner. So, it is ordered that the petitioner (Varun alias Monu) be released on bail on his furnishing bail bonds to the satisfaction of the trial Court. Disposed of. Petition allowed.
