JUDGEMENT

(1.) THE petitioner has been taken in custody on the allegation that he has committed an offence of manufacturing spurious lubricating oil for auto vehicle and was selling the same. His application for bail in the court of Special Judge, Bathinda was rejected on the ground that Section 12 (AA) of the Essential Commodities Act is a complete bar to the grant of bail. While dealing with that question in Cr1. Misc. Application No. 2533 -M of 1996.

(2.) I have considered that provision and found that bail can be granted as such cases. Adulterated lubricants tins have already been recovered and the petitioner is in the judicial custody, his presence in the trial Court can be secured on the basis of the bail bond. There is nothing to indicate that his further detention in the trial Court was inevitable. In these circumstances petitioner is granted bail on executing bail bond and surety bond to the satisfaction of C.J.M. Bathinda. Dasti.
