JUDGEMENT

(1.) Heard.

(2.) Statement of Suman alias Sonu prosecutrix was recorded by the Magistrate. under Section 164 Cr.P.C. In that statement, she has not insinuated anyone so far as rape is concerned and all that she has alleged against Anand is that she was kidnapped from the unlawful guardianship of her parents with intent to be used for illicit sexual intercourse Suman @ Sonu is shown to have been born on 10.10.1979. In April 1996, she was thus, 16 years 4 months old. Ossification test shows that she should be 17-19 years old.

(3.) Learned counsel for the petitioner submits that no wonder, she was a consenting party to the act of elopement with Anand etc.
