JUDGEMENT

(1.) Petitioners who are working as Central Sterilization Supply Department Attendants (hereinafter referred to as CSSD Attendants) in Pt. B.D. Sharma Medical College and Hospital, Rohtak (hereinafter referred to as the respondent Collage) have filed this petition for issuing a writ of mandamus directing the respondent-College to pay scale higher than the post of Packer in the Govt. of Haryana on the plea that post of Packer is a feeder post to that of CSSD Attendants.

(2.) Petitioners (No. 1 was appointed a Packer by the respondent-college on 13.8.1975 in the pay scale of Rs. 300-400. Similarly Petitioner No. 2 was appointed as a Packer on 24.11.1976 in the same pay scale. Principal of the respondent-College advertised/circulated 14 posts of C.S.S.D. Attendants in the pay scale of Rs. 400-600 on 7.11.1984 which were to be filled in from amongst the Class IV employees of the respondent-College itself. It is averred that for the purpose of appointment/promotion to the post of C.S.S.D. Attendants, Operation Theatre Attendants, X-ray Attendants, Library Attendants, Lecture-Theatre Attendants and Laboratory Attendants, the feeder posts are the post of Packers.

(3.) Petitioners applied for the post of C.S.S.D. Attendants in pursuance to the advertisement issued by the Principal of the respondent-college. Petitioners were selected and appointed as C.S.S.D. Attendants. Appointment letter of petitioner No. 1 has been attached as Annexure P2.
