CHIMAN LAL Vs. STATE OF PUNJAB AND ORS.

JUDGEMENT

(1.) The petitioner was appointed as an Electrician in the P.W.D. (B & R) on work charge basis and his services were regularised w.e.f. April 1,1975. As per rule 5-A(C) of the Punjab Public Works Department (B & R) Branch Sectional Officers (Engineering) Service Class HI Rules, 1964 5% posts of Sectional Officers are to be filled in by promotion from Electricians who had passed two years course as Trademan in Electrical Trade having passed electrical supervisor competency certificate examination held by the Electrical Inspector to Government of Punjab and had atleast five years' experience in the Department and another 5% posts are to be filled in by promotion from Electricians, who were matriculate and had no technical qualifications but have passed electrical supervisory competency certificate examination and have ten years practical experience in the Department. The petitioner belongs to the first category mentioned above. His case is that in 1982 he was not promoted to the post of Sectional Officer (now designated as Junior Engineer though his juniors were promoted. He has appended order dated October 5, 1982. Copy Annexure P-l, to substantiate his submission. In the said annexure, from the category to which the petitioner belongs five names are mentioned. They are S/Shri Sikandar Singh, Subhash Chander, Madan Mohan, Ajaib Singh (B.C.) and Chiman Lal.

In para 5 of the reply filed on behalf of the respondents, it has been mentioned that in fact names of these officials including the petitioner were considered for promotion as Sectional Officers in the year 1982. Shri Ajaib Singh aforesaid was promoted against reserved point being, a member of the backward class and the other two candidates viz. S/Shri Sikandar Singh and Subhash Chander were promoted in order of seniority. The other candidates including the petitioner could not be promoted for want of vacancies falling to the share of category-I.

(3.) After hearing the learned counsel for the parties, 1 am of the view that the petitioners has no case for claiming promotion w.e.f. the date Sikandar Singh and Subhash Chander got promotion.
