SHAMSHER SINGH Vs. PUNJAB STATE

Decided On January 25, 1996
SHAMSHER SINGH Appellant
V/S
PUNJAB STATE CIVIL SUPPLIES CORPORATION LTD Respondents

JUDGEMENT

(1.) This letters patent appeal is directed against the judgment and order dated March 16, 1993, passed by the learned Single Judge in Civil Writ Petition No.1978 of 1981. The learned Single Judge held that after the expiry of three months' period for which the appellants were appointed, they had no right to continue as Sub-Inspectors. Consistent with this finding, the learned single Judge dismissed the writ petition.

(2.) Mr. Goyal, the learned counsel for the appellants, however, urged that notwithstanding the fact that the appellants were appointed on adhoc basis against purely temporary posts, they ought to have been considered for regularisation in the cadre of Sub-Inspectors. We are unable to appreciate this contention since the very appointment itself of all these appellants would indicate that they were appointed against purely temporary vacancies on adhoc basis. Considering the rigour of termination of services, the respondent Corporation afforded the appellants and others, alternative jobs as Shop Assistants, Gradc-I with a view to rehabilitate them. It is the finding of the learned Single Judge that the appellants have accepted these alternative jobs. No contention is raised by the learned counsel for the appellants that they have not accepted and joined the alternative jobs. In view of this factual position, in our opinion, there is no error in the impugned judgment. There is no substance iri the letters patent appeal. Letters patent appeal to stand dismissed. In the circumstances, there will be no order as to costs.
