BOTH these petitions are being disposed by this common order because the petitioners arc the father and grand -father, respectively, of one Rekha whose wedding ceremony is scheduled to take place on 9th March, 1996. Both these petitioners were convicted for the offence punishable under Section 302 I.P.C., by order dated 6.11.1993, and they are undergoing imprisonment for life. Since the wedding of Rekha was scheduled on 9th March, 1996, these petitioners submitted application dated 16.2.1996, to respondent No. 3 Superintendent District Jail, Bhiwani, and sought emergency parole under Section 3 of the Haryana Good Con - duct of Prisoners (Temporary Release) Act. They prayed that for four weeks parole may be granted to them. Since that application was not disposed of with the proper despatch with which it should have beep, the petitioners rushed to the Court by filing these petitions on 20.2.1996 for seeking direction to release them on parole. In view of the limited time now available at the disposal, and in view of the facts of these cases, this Court on 23.2.1996 ordered notice to the Advocate General, Haryana. The matter was taken up behalf of the State of Haryana, informs me that he has not received any instructions though a radio message had been sent to the Superintendent of District Jail, Bhiwani, and he was expected to give necessary instructions. Despite that the Superintendent, District Jail, Bhiwani, had not cared to contact the office of the Advocate General, Haryana. The Director General of Prisons, Haryana, Chandigarh, is directed to hold enquiry and fix the responsibility of such negligency in duties and proceed against the person in the manner as he would deem proper.
(2.) IN the set of circumstances, I am left with no alternative but to consider the averments made in these petitions. As per those averments, the wedding ceremony of Rekha is thus fixed as stated above. It is obvious that father and grand -father of Rekha should be granted a brief liberty to attend the wedding ceremony, and for that purpose they deserve the parole for a period of 15 days from the date of their release on parole after following the due procedure. Both these cases are disposed of with that direction.
