(1.) This petition has been filed for issuance of a direction to the respondents to consider and appoint the petitioner as a Lecturer in English or in Punjabi against the posts reserved for sports persons.

The petitioner, who is M.A. in English as well as in Punjabi and who has also passed B.Ed. as well as M.Ed., applied for recruitment as Lecturer in English/Punjabi in response to the advertisement issued by the Departmental Selection Committee (Teaching) Punjab (published in the Daily Tribune dated Dec. 28, 1994). Along with the application form, the petitioner attached sports gradation certificate issued by the Sports Directorate, Punjab and claimed that he should be considered for appointment against the posts reserved for sportsmen under the Punjab Recruitment of Sportsmen Rules, 1988. The petitioner was called for interview on 27.3.1995 for the post of Lecturer in Punjabi and on 17.4.1995 for the post of Lecturer in English. In the result published by the Departmental Selection Committee name of the petitioner does not figure. The result published in the Daily Tribune dated June 30, 1995 shows that 150 candidates have been selected for appointment as Lecturer in English and 100 candidates have been selected for appointment as Lecturer in Punjabi. The female candidates have been selected against the general category and also against the posts reserved for sports persons but no male candidate has been selected against the quota of sports persons.

The grievance of the petitioner is that the respondents have not considered his candidature for appointment against the vacancies reserved for sports persons and he has deprived of valuable right which was available to him under the Rules of 1988. He has relied on the circular dated 19th July, 1989(Annexure-P.7) issued by the Government of Punjab reserving 3% posts in favour of sportsmen/sports women in Class-III and Class-IV services.
