(1.) COUNSEL for the petitioners has contended that petitioners have been convicted solely on the ground that they are the beneficiaries the sale -deed. In this regard, he has referred to certain observations of the appellate court.
(2.) AFTER hearing the learned counsel, I am of the view that that is no merit in the petition. Learned Judicial Magistrate has noticed that the sale -deed was used by the appellants in civil suit filed by the complainant in which they asserted that the sale -deed in their favour is genuine document. in this view of the matter, no interference is called for. Accordingly, revision petition qua petitioners 1 to 3 shall stand dismissed. As regards petitioner No. 4, considering that petitioner No. 4 is at present more than 90 years of age and is the first offender, I am of the view that benefit of probation deserves to be extended to him. Accordingly, petitioner No. 4 is ordered to be released on probation for a period of one year on his famishing personal bond in the sum of Rs. 5,000/ - with one surety in the like amount, undertaking that he Shall appear in Court to receive sentence as and when directed to do so during the said period of one year and in the meantime to keep peace and be of good behaviour. Ordered Accordingly.
