(1.) THE present is a revision petition under Section 16 of the Punjab Land Revenue Act, 1887, against the order dated 29th September, 1994, passed by the Commissioner, Jalandhar Division, Jalandhar, in a Lambardari case.

THE Collector, Gurdaspur had ordered the appointment of Mani Singh son of Shingara Singh, as Lambardar of village Chak Yakub, Tehsil and District Gurdaspur, in place of Sardar Mohammad, who had migrated to Pakistan after partition in 1947, after considering the comparative merits of Sarvshri Darshan Singh, Singara Singh and Mani Singh. The claim of Darshan Singh was rejected by the Collector, Gurdaspur, on the ground, that, in his application dated 10.1.1991, he had mentioned that he had passed middle class, whereas, according to his school leaving certificate, issued on 13.11.1991, he has studied upto the 7th class. On the basis of this, the Collector was of the opinion that Darshan Singh was "not a reliable person to be appointed as Lambardar of the village", as per the Collector's order dated 18th August, 1992. During hearing by the District Collector, an objection was raised against Mani Singh, by the opposite counsel, that, the being an employee of the Sugar Mill Paniar, was not fit to be appointed as Lambardar, but this was ignored. The appeal filed by Darshan Singh, against the Collector's order, was accepted by the Commissioner, Jalandhar Division as per his order dated 29.9.1994, who had set aside the appointment of Mani Singh as Lambardar, and, in his place, Darshan Singh was directed to be appointed as Lambardar. Aggrieved by the Commissioner's order, Mani Singh has filed the present revision petition on the grounds stated in his petition dated 23.1.1995.
(3.) IN view of the above discussion, the present revision petition is hereby dismissed.
