JUDGEMENT

(1.) THE prayer in revision here is for the reduction of the period of detention of the petitioner as fixed by the State Government under Section 34 of the East Punjab Children Act, 1949.

(2.) THE petitioner -Gamdoor Singh was convicted for an offence under Section 302, Indian Penal Code by the judgment of the Sessions Judge, Bhatinda of June 9, 1982. The conviction was in respect of an occurrence which had taken place on November 25, 1980. The State Government, by its order of February 27, 1986, fixed the date of birth of the petitioner to be November 29, 1966. On this basis, the petitioner was 14 years of age at the time he committed the offence. The State Government, by its order of July 17, 1985, has directed that the petitioner be kept in Borstal Jail until be attains the age of 21 years, that is, till July 25, 1967.

(3.) KEEPING in view the fact that the petitioner was only 14 years of age at the time of the commission of the offence and that he has already been in detention for almost six years, the period of his detention is reduced to till the date he attains the age of 20 years.
