PANDU Vs. STATE OF HARYANA

JUDGEMENT

(1.) THIS order will dispose of Cr. M. Nos. 3748 - M and 3749 - M of 1986. These pertain to one and the same petitioner named Pandu.

(2.) THE petitioner was accused, in the first instance, on 19th May, 1986, to have fired his country made pistol on Jit Ram and thus a case for attempt of murder and for user of a fire arm under sections 25 and 27 of the Arms Act was registered against the petitioner. Later on 24th May, 1986, when the matter was being investigated, the petitioner by means of a statement under section 27 of the Evidence Act got recovered a 12 bore country made pistol and one live cartridge thereof. It is in this manner that two first information reports stand recorded against him for two offences but pertaining to the same country made pistol. Though it is true that the petitioner has been accused of having used the country made pistol, yet, there is no damage, for no injury was caused to anyone.
