JUDGEMENT

(1.) The petitioner Surinder Mohan, who appeared for his Matriculation Examination of the Punjab University in 1965 was disqualified by a letter of the respondent-University addressed to him on 24th of August, 1965 (Annexure B). The disqualification was affirmed in appeal by the Vice-Chancellor and the examinee feeling aggrieved has preferred this petition under Articles 226 and 227 of the Constitution to this Court for redress.

(2.) The impugned order is contained in Annexure B and is to this effect :-

The petitioner then received a communication from the University office on 28th of April, 1965 (Annexure A) and was informed that a complaint had been received against him for having used unfair means. The petitioner was advised to see the Assistant Registrar of the Punjab University on 5th of May, 1965, at 9 A.M. The petitioner instead saw the Assistant Registrar on 3rd May, 1965 and was handed over a questionnaire which judging from the nature of questions was of most searching nature. Out of the nine questions which the petitioner was asked to answer on the spot, at least seven were aimed to elicit enquiries into unfair means. As no case had been made out against the petitioner for using unfair means, his case was recommended to be dealt with under clause (c) of regulation 14, which deals with misbehaviour. The only question which pertains to this aspect in the questionnaire is No. 4 which is to this effect :-
