JUDGEMENT

(1.) This is an appeal by Ram Chander against his conviction under section 411 of the Indian Penal Code by Mr. E.F. Barlow, Additional Sessions Judge of Karnal.

(2.) Ram Chander was prosecuted for possession of a stolen bullock which, along with another bullock and a cart, was alleged to have been stolen from the village of the complainants on the night between the 20th and 21st February 1956. A search party then proceeded to look for these stolen bullocks and the cart and P.Ws. Ram Chander and Bhartu were sent to Uttar Pradesh to look for the stolen cattle, and two or three days later they came with the information that they were in possession of the accused Ram Chander in village Kunda in U. P. This information was given to the police on the 3rd March 1956.

(3.) Ten witnesses were examined on behalf of the prosecution. Amar Singh P.W. 1 proved that the theft had taken place and that Bhartu and Ram Chandar P.Ws. were sent to U.P. to search for the stolen bullocks and the cart. Bhartu P.W. 2 and Ram Chander P.W. 3 have appeared in the witness-box and have deposed that when they reached Kunda they found the accused sitting in the house of Sadhu sweeper with one of the stolen bullocks which was recovered from him and this is supported by Zafru P.W. 4, Chowkidar of village Kunda.
