The petitioner is seeking interim bail for a period of fifteen days in case arising out of FIR No. 536 dtd. 18/11/2020 registered under Sec. 346 of IPC (Ss. 302, 365 and 404 read with Sec. 34 of IPC added during investigation) at Police Station Sampla, District Rohtak. He has been facing trial for commission of offence of murder of the victim Maninder committed on 16/11/2020. He has prayed for grant of interim bail on the ground that his brother Hitesh had met with an accident on 12/12/2025 and sustained serious injuries and his hip bone was fractured. He has undergone surgery and has been discharged on 22/12/2025.
(2.) It is submitted by learned counsel for the petitioner that his father has already died. His old-aged mother is taking care of his injured brother. His brother has been advised complete bed rest and is undergoing risk of muscle/bone loss due to prolonged rest. His presence is required for taking care of his brother. It is therefore, urged that he may be extended benefit of interim bail.
(3.) The respondent-State has filed reply. It is argued by learned State counsel that the allegations against the petitioner are serious in nature. His brother has already undergone surgery and has been discharged from hospital and is in the process of recovering. The mother of the petitioner is taking care of her son and has also recorded her statement. There are chances of petitioner's absconding if extended benefit of interim bail. No reasonable ground is made out for allowing the petition. Therefore, it is stressed that the petition does not deserve to be allowed.
