(1.) The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of result to the extent that candidature of petitioner has been rejected. He is further seeking direction to respondent to grant him four marks for degree of B.Tech. (IT).
(2.) The petitioner pursuant to Advertisement No.3/2018 dtd. 16/4/2018 applied for the post of Sub Inspector. In the said Advertisement, 184 posts were earmarked for General category and 72 posts for SC category. The petitioner belongs to SC category. He participated in the selection process, however, could not be finally selected because he could not achieve cut off marks. As per Advertisement, there are 04 additional marks for graduation degree in Computer Engineering/Science (which take 04 or more years after 10+2). The petitioner is possessing degree of B.Tech. (IT). He claims that B.Tech. (IT) is equivalent to graduation in Computer Engineering/Science.
(3.) Learned counsel for the petitioner on being confronted with judgment of this Court in Manju Rani V/s State of Haryana, Law Finder Doc Id #2755131 expressed his inability to controvert the applicability of the same to the instant case.
