JUDGEMENT

(1.) The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of certiorari, for quashing the seniority list (Annexure P/14) to the extent it declares the petitioners as having been regularised w.e.f. 31/12/1990 and respondents No.3 to 10 as senior to the petitioners. Further, a writ of mandamus has also been sought for restraining the respondent-department from making promotions to the post of District Programme Officers from amongst respondents No.3 to 10 on the basis of the impugned seniority list and to regularise the services of the petitioners in terms of policy instructions as contained in Annexure P/9 and to fix the seniority of the petitioners at the appropriate place in the seniority list (Annexure P/14).

(2.) Learned State counsel and learned counsel for respondent No.8 are ad idem that since the petitioners and private respondents have already retired from service, the relief claimed in the present petition has been rendered infructuous.

(3.) Disposed of as having been rendered infructuous.
