JUDGEMENT

(1.) The petitioners -defendants are aggrieved of the dismissal of the application filed under Order 6, Rule 17 CPC.

(2.) Learned counsel appearing on behalf of the petitioners submits that in a suit for declaration, the petitioners defendants had filed written statement and wanted to seek amendment of the written statement by incorporating legal objections 9 and 10 as well as counter claim under the provisions of Order 8, Rule 6A Code of Civil Procedure which has erroneously been dismissed.

(3.) He further submits that plea of adverse possession by way of counter claim can be taken.
