JUDGEMENT

(1.) This is an application for suspension of sentence of the applicant-appellant Balram.

(2.) Learned counsel for the applicant-appellant has argued that the applicant-appellant has undergone 03 months and 11 days out of total sentence of 02 years. Learned counsel for the applicant-appellant further argued that the applicant-appellant had actually been released on interim bail by the learned trial Court but he could not press the present application on time and, therefore, surrendered.

(3.) In these circumstances, keeping in view the fact that the appeal is admitted which is not likely to be heard in near future and also the fact that the recovery effected from the applicant-appellant is much less than the commercial quantity, I deem it appropriate to suspend the sentence of the applicant-appellant.
