JUDGEMENT

(1.) Prayer in this petition under Section 438 of Cr.P.C. filed on behalf of the petitioner -accused -Harmesh Singh is for grant of anticipatory bail in case FIR No. 04, dated 05.01.2016, for offences punishable under Sections 308, 279, 337, 338 of the Indian Penal Code, registered at Police Station Sadar, Fazilka.

(2.) As per the allegations levelled by complainant -Niranjan Sijngh, 60 years old, on 22.12.2015 at 4.00 p.m. when he was returning from the house of his brother, the petitioner -accused -Harmesh Singh, with an intention to kill him, hit him with his motor cycle driven at a very high speed while also inflicting a pipe blow.

(3.) Learned counsel for the petitioner submits that upon enquiry by the DSP, recommendations for deletion of offence under Section 308, IPC has been made and the rest of offences are bailable. He further submits that the petitioner has since joined the investigation and nothing is to be recovered from him.
