JOGINDER SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) This petition has been filed under Sec. 482 of the Code of Criminal Procedure for quashing of FIR No.49 dtd. 11/7/2013, registered under Ss. 324, 323 and 148 of the Indian Penal Code (for short 'the IPC') read with Sec. 149 IPC and Sec. 326 IPC (added later on), at Police Station Dera Baba Nanak, Distt. Gurdaspur, and all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

(2.) Vide order dtd. 4/8/2016, the parties were directed to appear before the Illaqa Magistrate/trial Court, for getting their statements recorded. In compliance thereof, report of learned Judicial Magistrate 1st Class, Batala, dtd. 27/9/2016, has been received, wherein, it has been noticed that the compromise between the parties is genuine, voluntary and reached without any pressure and undue influence.
