JUDGEMENT

(1.) This is an application under Order 41 Rule 9 read with Section 151 of CPC for restoration of the appeal, which was dismissed for want of prosecution on 1-4-2016.

(2.) Notice of this application was issued. No one has appeared on behalf of the non-applicant/respondent to oppose the prayer made in the application.

(3.) After hearing the learned counsel for the applicant-appellant and perusing the averments made in the application, which is supported by an affidavit of the learned counsel for the applicant-appellant, the same is allowed and the appeal is ordered to be restored to its original number.
